The Insolvency Service’s recent proposal to sanction the use of public servants to arbitrate in insolvency cases has been generally slammed as a step too far by the profession. The reforms suggested by would see petitions for bankruptcy and winding-up done online rather than in the Courts which could lead to abuse of the system.
“By-passing the formal Court processes is of some concern. Experienced Judges are more than capable of uncovering devious bankruptcy applications whereas civil servants acting as both judge and jury to online applications could well let unscrupulous applications through the net,” said Gerald Irwin of Sutton Coldfield based Licensed Insolvency Practitioners and Business Advisers Irwin Insolvency.
